The move shown in your example was legal because the stone
placed was not part of both threes, it revealed one of the
threes by capturing a blocking stone of an existing three.

Additional description of the rules not seen in all help files:

A move that forms a 3-3 due to capturing is not allowed, but a
capturing move that reveals a 3-3 is allowed.
