i think it depends on the circumstances, which were not presented.  I don't 
see how the PCs being attacked _could_ avoid killing him, or at the very 
least kicking him out.  But much depends on the stated reasons the offending 
PC was attacking, whether the combat was fatal (are we talking a fist fight 
or a shootout), how the combat went (if they aced three times and ended up 
with 60+ damage, the guy's probably dead regardless of their feelings :) ), 
and what the offending PC said after he woke up (assuming he was knocked out 
in the combat, and it was of a fatal variety).
