Because you have a right to copy the data of the book -- not the book 
itself. The physical layout, etc, is not governed by the OGL; only the text is.

You can, of course, convert the text into a PDF once you've scanned it, but 
the point is that you cannot simply "scan the book", even if it is 100% 
open content.
